Dear Tennessee Affiliate:

The General Assembly in Nashville has introduced two anti-affiliate bills, SB 1741 in the Senate and HB 1947 in the House. This legislation could force out-of-state merchants to shut down their affiliate programs.

How would that impact your business?

SB 1741 is scheduled to be heard by the Senate Finance, Ways & Means Tax Subcommittee TODAY. HB 1941 is scheduled to be heard tomorrow, May 13, in the House Finance, Ways & Means Budget Subcommittee.

It is critical that you send emails of opposition to the committee members as soon as possible! It is our hope that your letters regarding the negative impacts of this legislation on your livelihoods will result in the bills being dropped from the agendas. It happened in California! It can happen in Tennessee, too. Through the letters of opposition, your representatives will hear your opinions voiced, increasing the chances of that happening.

So please, contact the chairs of the committees over the next few days. It only takes a few minutes to make a difference! If you would like, feel free to contact the other members of the committee as well! It can't hurt.

Because your businesses are under threat, it is imperative that your messages are heard.

Below are two e-mail templates for you to use - one for the Senate and one for the House.
The contact information for the committee chairs and vice chairs is also included below the letters. Please send an e-mail to each of them; it will only take a few minutes of your time.

I am a small business owner with a website, and I am in strong opposition to SB 1741, which would require retailers that advertise and receive direct or indirect referrals from advertising on websites, such as mine, to collect sales tax in Tennessee.

I am opposed to this bill because it would substantially harm my small business by reducing a large source of revenue that I depend on to survive. This revenue results from providing advertising on my website on behalf of out-of-state retailers. [Describe how your business model is set-up and what you contribute to the local economy.]

If retailers believe that doing business with me will result in their having to collect sales tax on all Tennessee sales, they likely will sever ties with my business, putting the viability of my business at risk. Such was the case in New York State where Overstock dismantled its affiliates program and hundreds of other business followed Overstock's example. This left thousands of affiliates - most of which are small and medium-sized businesses with a major loss of income.

For these reasons, I respectfully oppose this legislation.
